WHAT IS WORKER’S COMPENSATION INSURANCE?

  • Worker’s Compensation Laws were created to insure that employees who were injured on the job were provided with health care and disability benefits. Because these benefits were outlined under state law, this eliminates the need for litigation and creates an easier process for the employee.
       
  • Worker’s Compensation is not health or disability insurance. It is designed specifically for injuries sustained on the job. For more information on general employee benefits, go to our Group Insurance Benefits section of this website.
       
  • Worker’s Compensation Insurance is designed to help employers pay these benefits. As protection for employees, most states require that you carry some form of Worker’s Compensation Insurance. Even if it weren’t mandatory, this coverage would be a good idea if you employed several employees, especially if they engaged in hazardous services or construction.

WHO RECEIVES THE BENEFITS?

Employees who are injured as a result of their job may be eligible for worker’s compensation benefits.
   

  • Questions may arise as to whether the condition occurred while the employee was at work, and if it was the employment’s fault. This definition covers many common workplace injuries.
       
  • Some employers are not required to carry worker’s compensation. Please consult our Commercial Insurance Department for the requirements of the State of Louisiana.

WHAT BENEFITS ARE PAYABLE?

   

  • All reasonable and necessary medical care. This includes everything necessary to treat the effects of the injury. There is no deductible or dollar limit for the covered treatment.
       
  • Disability benefits. Two-thirds of the employee’s average weekly wage will be paid tax-free due to lost wages, because the injured employee cannot return to work.
       
  • Death benefits. Payments are made to the surviving dependents, including a set funeral benefit. If there are no dependents, benefits are paid to biological parents.
       
  • Rehabilitation services. If the injured employee is prevented from returning to his previous occupation, he may qualify for vocational rehabilitation to prepare him for reentering the workforce in a different position.

HOW MUCH DOES WORKER’S COMPENSATION INSURANCE COST?

Rates are based on the number of employees, job description or class code, and amount of payroll.
